These terms and conditions apply to purchases made from Cornado Pty Ltd T/A Suppleyes (“Suppleyes“) by the purchaser (You/Your).
Prices and payments
All orders placed are subject to confirmation and acceptance by Suppleyes.
Suppleyes may vary prices in the event of price changes with reasonable prior notice to You. If Suppleyes requests payment for increased prices, You may cancel the order by giving notice to Suppleyes, which must be received within two days of notice of the increase.
GST and/or any other Government imposts whatsoever applicable to the supply and/or services will be payable by You.
Payment for goods purchased from Suppleyes must be made by You on or before delivery or in the case of customers who have an account with Suppleyes, within the trading terms agreed.
Payment made to Suppleyes must be made without deduction or set-off.
Suppleyes can set-off any moneys owed to it against any debt Suppleyes owes to You.
Title and Risk
Suppleyes shall retain title of the goods supplied until all monies owing for those goods and any other good supplied by Suppleyes are received in full. Suppleyes reserves the right to recover said goods from You at any time.
The risk in goods passes to You at the point of delivery. Once the goods are delivered to You, it is Your responsibility if the goods are lost or damaged. Suppleyes reserves the right to take a security interest over all goods supplied to you.
Your Account
You agree to take responsibility for the safekeeping of Your user name and password. You are liable if Your user name or password is used by an unauthorised person. You agree to release and indemnify Suppleyes in connection with any use (whether authorised or unauthorised) of Your user name or password. Suppleyes may suspend or cancel Your account at any time without prior notice.
Liability
To the extent allowable by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on the Suppleyes are excluded under this agreement, however nothing in this agreement excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or any other statute, provided that, to the extent that such law permits Suppleyes to limit its liability, then Suppleyes’ liability is limited to replacing any goods that have been supplied or paying the cost of replacing the goods.
Changes to Terms
Each order is ruled by the terms and conditions current once the order is placed. Suppleyes may add to, delete or otherwise change these terms and conditions without notice. It is Your responsibility to browse and perceive these terms and conditions every time You place an order.
